Here is an article about a malware application that infects Android phones, and sends text messages to premium rate numbers. It should also be possible for an application like this to make calls to premium rate numbers. You could also use an applciation like this to generate call floods.
Can you call your service provider and file a dispute? Since you didn't make those text messages your self.

I do not know. I suspect they would make it very difficult to report it and I doubt you would be able to get reimbursed.

Does this continue even if you switch off the phone?
